Terms of Service

Last updated: 14 September 2026

1. About these terms

DriveWise AI (the "Service") is operated by Hart & Heim Pty Limited (ABN 23 123 508 663) ("we", "us"). By creating an account or using the Service, you agree to these terms. If you don't agree, don't use the Service.

2. What DriveWise AI does

DriveWise AI helps rideshare drivers in Sydney and Melbourne decide when and where to drive, and keep track of what driving pays. It includes demand scores, a shift planner, flight, event and traffic information, a shift log with earnings after costs, a trip check, an airport go-or-stay guide with rank queue reports from other drivers, GST and car expense estimates, a minimum pay check, a toll check, an income tax estimate, car cost comparisons, a paperwork calendar, car care reminders, an incident log, hours driven across shifts, a super and time-off set-aside, free public calculators, a car logbook, receipt storage, a year-end pack, a live shift timer, car mode, alerts, a CSV import for past earnings, an optional Monday email, and an AI advisor.

DriveWise AI is independent. It is not affiliated with, endorsed by or connected to Uber, DiDi, Bolt, inDrive, Shebah or any other platform, and has no access to your accounts with them.

3. Your account

  • You must be at least 18 and give accurate details.
  • Keep your login secure. One account per person; accounts can't be shared.

4. Trial, subscriptions and billing

  • New accounts get a 7-day free trial with no card required. The trial includes 5 AI advisor queries.
  • Referrals: a new account that signs up with a driver's code in its first three days gets a 30-day trial instead. When that driver starts a paid subscription, the referrer gets a credit worth one month of the monthly plan on their DriveWise AI account, used on future invoices, up to 12 credits a year. Credits have no cash value and we may end the program with notice.
  • After the trial, the Service requires a subscription: $14.99 AUD a month or $99 AUD a year.
  • Payments are processed by Stripe. Subscriptions renew automatically until cancelled; you keep access until the end of the paid period.
  • If a payment fails, access continues for a short grace period (currently 7 days) while payment is retried.
  • AI features have fair-use limits to keep costs sustainable (currently up to 40 queries a day per account, plus hourly limits). We may adjust limits, and will tell subscribers before reducing them.
  • We'll give existing subscribers at least 30 days' notice of a price change, which applies from the next renewal.
  • Refunds: we consider requests made within 14 days of a charge. Nothing in these terms limits refunds or remedies you're entitled to under the Australian Consumer Law.

5. Estimates, not guarantees

  • Demand scores, best hours, surge and arrival waves, likely earnings and airport calls are estimates based on typical patterns, listed events, timetables, weather and drivers' logged shifts. The app says where each figure comes from and when information is missing. None of them guarantee demand, trips or earnings.
  • Third-party information (flights, events, weather, traffic, fuel prices) can be late, incomplete or wrong. We show it as supplied and can't guarantee its accuracy.
  • AI advisor answers can be wrong. Use your own judgement.
  • Net earnings, trip checks and tax figures are only as good as the numbers you enter, including your car costs. Until you enter your own, the app uses placeholder costs and says so.

6. Tax and financial information

GST worksheets, amounts to set aside, BAS due dates, car expense comparisons and exports are estimates to help you keep records. They are not tax, financial or legal advice. You're responsible for your own tax obligations, including registering for GST and lodging BAS returns. Check official guidance from the Australian Taxation Office or get advice from a registered tax agent.

7. Driving safely and lawfully

  • Don't use DriveWise AI in a way that breaks road rules. Mobile phone laws in NSW and Victoria restrict touching a phone while driving; set up plans, trip checks and logs when parked, and keep any phone in a fixed cradle.
  • Break reminders and 10- and 12-hour warnings are general guidance, not legal limits or a fatigue management system. You're responsible for driving only when you're fit to, and for following your platforms' rules and your state's point-to-point transport laws.
  • Car mode and alerts are designed to be glanced at, not handled. Start them while parked, use a fixed cradle, and ignore an alert until it's safe and legal to look.
  • DriveWise AI never accepts, declines or manages trips for you. Every decision to drive, accept or decline is yours.
  • You're responsible for making sure your use of DriveWise AI alongside a rideshare platform complies with that platform's terms.

8. Your information

  • You own the shifts, earnings, costs and notes you enter or import. You can edit, delete or export them. Check imported shifts: the import reads your file as mapped and can only be as right as the file and the mapping.
  • Airport rank reports should be honest and made from the rank itself. They're shown to other drivers without your name. Reports are drivers' impressions, not a measured queue length.
  • Toll checks, income tax estimates and car cost comparisons are worked out from files and figures you provide. They're estimates for your records, not tax or financial advice, and a toll check isn't proof a platform owes you money.
  • The logbook, car claim comparison and year-end pack are built from the readings, receipts and costs you enter, and follow the ATO's published rules as we understand them. You're responsible for your records being accurate and complete, for choosing a claim method, and for what you lodge. Keep copies of your receipts: download your records before deleting anything.
  • Hours driven and fatigue warnings come from the shifts you log and are general road-safety advice, not a legal limit or a judgement that you're fit to drive. Stop when you're tired, whatever the app shows. Car care intervals are starting points; follow your car's manual. The incident log is your own record: it doesn't report anything to a platform, insurer or police. The free calculators and the super and time-off figures are estimates, not financial or tax advice.
  • Paperwork reminders only use the dates you enter. You're responsible for knowing what applies to you and renewing on time.
  • The minimum pay check compares your records with a floor you choose. It isn't a legal minimum or legal advice; no minimum pay standard applied to rideshare driving when this was written.
  • You allow us to use them to provide the Service to you and, in de-identified form combined with other drivers' data, to calculate city-level figures that improve the Service for everyone, as described in our Privacy Policy.

9. Acceptable use

You agree not to:

  • use the Service unlawfully, or to harass or harm anyone;
  • scrape, copy, resell or redistribute the Service's data, or access it with automated tools without our written permission;
  • try to get around limits, trials or payment (for example by creating multiple accounts or entering false shifts to influence city figures);
  • make false or misleading rank reports;
  • create accounts to claim referral rewards for yourself, or share referral codes through spam;
  • reverse-engineer the Service, or interfere with its security or infrastructure.

10. Intellectual property

The Service, including its software, design, scoring methods and content, belongs to us or our licensors. Some information is shown under licence from third parties (for example traffic data © TomTom and maps from Esri and OpenStreetMap contributors).

11. Availability and changes

We aim to keep DriveWise AI available but don't promise uninterrupted service. Features and data sources may change, for example if a provider stops supplying data. We'll tell subscribers about significant changes that reduce the Service.

12. Liability

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees or any other right you have that can't lawfully be excluded.

Subject to that, and to the extent the law allows:

  • we're not liable for lost earnings, fines, penalties, tax liabilities or other indirect or consequential loss arising from decisions you make using the Service;
  • our total liability to you is limited to resupplying the Service or refunding what you paid us in the 12 months before the claim.

13. Ending your use

You can cancel your subscription at any time from your Profile, and close your account there too (or ask us to, by emailing privacy@drivewiseai.com.au). We may suspend or close accounts that seriously or repeatedly break these terms, and will explain why unless the law prevents it.

14. Changes to these terms

We may update these terms. We'll tell you by email or in the app at least 14 days before a material change takes effect. If you don't agree, you can cancel before then; continuing to use the Service after that means you accept the change.

15. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the courts of that state.
