Uber Driver Requirements in NSW 2026
To drive rideshare in NSW you need an unrestricted driver licence held for 12 months in the preceding four years, you must meet the medical standards, and you must only accept bookings from an authorised booking service provider. Three rules catch experienced drivers out: your blood alcohol limit is 0.02, not the 0.05 that applies to ordinary driving; you may not queue or wait for work anywhere, including hotel forecourts; and you must display a retroreflective sign identifying the car as a hire vehicle.
Everything below comes from the Point to Point Transport Commissioner. Where a rule differs between taxis and rideshare, this covers rideshare.
The limit is 0.02, not 0.05
The Commissioner sets it plainly: a driver's blood alcohol concentration must be under 0.02 grams per 100 ml of blood.
That is not a stricter version of the normal limit, it is a different regime, and it is low enough that it is effectively zero for practical purposes. One drink can put a smaller person near it. If you are driving that night, do not drink at all. It is the simplest rule on this page and the most expensive one to get wrong.
You are a booked service, and only a booked service
This is the rule most often broken by accident. Rideshare drivers can only carry out booked passenger services, which means you must not ply, stand, queue or park for hire on roads, in taxi zones, in hotel foyers, or in other road-related areas.
The booking has to exist before you stop the vehicle at the pickup point.
Read that against how a lot of drivers actually work. Sitting outside a venue at closing time waiting for a ping is the grey area, and parking in a hotel forecourt hoping for work is not grey at all. Positioning near demand is legitimate and it is what the app is for; waiting for hire in a place reserved for hire is not.
The related rules follow from the same principle. You must not tout or solicit for passengers. Your car must not indicate in any way that it is a taxi, through livery, paintwork, markings, signs or lights resembling a taxi.
The sign most drivers do not know about
Drivers must display a retroreflective sign identifying the vehicle as a hire vehicle. It must be on or near the rear of the driver's side of the car, and visible from outside the vehicle.
This is a specific, checkable, physical obligation, and it is the one that most often surprises drivers who have been working for years. If you are not sure whether yours is compliant or correctly placed, that is worth resolving before an authorised officer resolves it for you.
Airport precincts
Sydney Airport is where enforcement is most visible, and the rules are narrow:
- Pick up and drop off only in the designated areas.
- Do not leave your vehicle unattended unless you are in a designated holding bay.
- Follow the directions of airport security and staff.
The practical consequence is that the holding bay is the only place you can legitimately wait, which makes the queue length the whole story for airport work. The Sydney Airport guide covers how to judge whether that queue is worth joining.
The rest of the obligations, briefly
| Obligation | What it means |
|---|---|
| Bookings | Only from authorised booking service providers |
| Smoking | Not while the vehicle is being used to provide a passenger service |
| Assistance animals | Cannot be refused, including animals in training |
| Additional passengers | Nobody rides without the hirer's consent |
| Authorised officers | Follow reasonable directions, and hand over your licence for inspection on request |
| Passenger Service Levy | Comply with your provider's directions on collecting it |
| Vehicle condition | Do not drive a vehicle you know, or ought reasonably to know, is non-compliant |
Seatbelt detection cameras have operated across NSW since 1 July 2024, and the road rules on seatbelts differ between taxi drivers and rideshare drivers. Hire car drivers follow the rideshare rules. Transport for NSW is the reference on that one.
Your platform can require more, and does
Booking service providers are allowed to impose standards beyond the law, and drivers must comply with their provider's policies. So the legal minimum on this page is a floor, not the full list. Vehicle age limits and ratings thresholds are platform policy rather than law, which is also why they change without any legislation changing.
Insurance is separate, and it is where the money is lost
None of the above is about insurance, and insurance is where an ordinary mistake becomes an expensive one. A personal comprehensive policy that excludes ride-sourcing pays nothing the moment you log in, and can be cancelled retrospectively.
Confirm in writing that your cover permits ride-sourcing. The rideshare insurance guide covers the layers, comprehensive against third party covers the level to choose, and Uber's own policy is one option if you drive on that platform alone.
Before your first shift in Sydney
- Unrestricted licence, held 12 months in the last four years.
- Medical standards met.
- Retroreflective hire vehicle sign fitted and visible.
- Nothing on the car that could read as taxi livery.
- Insurance confirmed in writing for ride-sourcing.
- The 0.02 limit understood as zero drinks.
Rules change and penalties apply for non-compliance. The Point to Point Transport Commissioner is the authority on your obligations, and worth checking directly rather than relying on any article, this one included.
Once you are compliant, the best hours to drive in Sydney is where the earning question starts.
